By accessing or using Westby (“the Service”), operated by Westby Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Westby generates AI-powered listing videos for real estate professionals. The Service includes video generation, hosting, and delivery. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@westby.ai if you suspect unauthorized access.
Certain features require payment. All prices are in USD. One-time purchases are non-refundable once video generation has begun. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel a subscription at any time from your account page; access continues until the end of the current billing period.

Upon payment, you receive a non-exclusive, perpetual license to use the generated videos for marketing the associated real estate listing. You retain ownership of any listing data you provide. We retain ownership of the Service, its technology, and underlying AI models.
Videos are generated using AI and publicly available listing data. While we strive for accuracy, we do not guarantee that all video content (including voiceover scripts, property details, or visual representations) is error-free. You are responsible for reviewing videos before sharing them publicly.
To the maximum extent permitted by law, Westby shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We may suspend or terminate your access at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately, though previously purchased and delivered videos remain yours to use under the license granted above.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or a notice on the Service.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
